This website is operated by Nadi. Throughout the site, the terms “we”, “us” and “our” refer to Nadi. Nadi offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on WooCommerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Section 1 – Refund, Cancellation & Rescheduling Policy

YOGA

Cancellations & rebooking into a class must be made before the start of class. Listed below are the terms and conditions for all the different yoga classes and passes at Nadi:

Terms & Conditions for Passes

  • Casual Drop In only valid for one yoga class
  • All 5, 10, and 20 class passes have a 12 month expiry from the date of the first visit
  • 1 Day Unlimited pass is valid only for the one day from 7am – 9pm
  • 7 Day Holiday Pass is only valid for 7 consecutive days starting on the day you book your first class
  • 1 Month Unlimited Pass is only valid for 30 consecutive days starting on the day you book your first class
  • All passes are valid for yoga in studio or livestream online. Not valid for workshops or 4 week series.
  • All passes are non-refundable but you can transfer them to a friend at no extra cost
  • Passes cannot be suspended nor the expiry extended

Terms & Conditions for Unlimited Yearly, Monthly & Weekly Memberships

  • Unlimited yoga in studio or livestream online with yearly, monthly or weekly memberships. Not valid for workshops or 4 week series.
  • Yearly membership suspension available anytime and are non refundable
  • Monthly membership has a minimum 3 month commitment. Suspension or termination available after the 3rd month (minimum 2 weeks notice prior to next scheduled payment) by emailing [email protected]
  • Weekly membership has a minimum 12 week commitment. Suspension or termination available after the 12th week (minimum 2 weeks notice prior to next scheduled payment) by emailing [email protected]
  • The remaining amount of your membership must be paid to us as a cancellation fee if you terminate your membership and automatic payment before the full amount has been paid off
  • Memberships are transferable to a friend at no extra cost
  • No refunds available after the automated payment has been processed
  • All Yearly, Monthly and Weekly Members receive a 35% Discount on select treatments (prices subject to change)
  • Currently: $89 for a 60 minute massage at Nadi (RRP: $149)
  • Currently: $129 for a 90 minute massage at Nadi (RRP: $199)

Terms & Conditions for 4 Week Series and Workshops

  • There are no refunds for 4 week series
  • If you are going to miss a 4 week series class, please let us know in advance to [email protected] so we can record and send the class to you
  • Workshop refunds are at the discretion of the teacher

Terms & Conditions for Private Yoga

  • If you cancel before 7 days, there’s a 100% refund
  • If you cancel within 7 days, there’s a 75% refund
  • If you cancel within 5 days, there’s a 50% refund
  • If you cancel within 24 hours, there’s a 25% refund
  • If you cancel in less than 24 hours, there’s a 0% refund
  • There is no fee to reschedule your private yoga if it is before 24 hours, however, teacher availability may be limited
  • Invoices must be paid before the private yoga session

MASSAGE

Cancellations & rescheduling appointments must be made 24 hours before the start of your appointment and must be made no later than 5.00pm the day before your treatment. If booked directly with us there is a 5% non-refundable credit card fee (included in all our prices as shown), this is non-refundable even when cancelled within the cancellation time-frame. When cancelled or no-show within the cancellation time, no refunds are possible.

SALT FLOAT

Cancellations & rescheduling appointments must be made 24 hours before the start of your appointment and must be made no later than 5.00pm the day before your treatment. If booked directly with us there is a 5% non-refundable credit card fee (included in all our prices as shown), this is non-refundable even when cancelled within the cancellation time-frame. When cancelled or no-show within the cancellation time, no refunds are possible.

INFRARED SAUNA

Cancellations & rescheduling appointments must be made 24 hours before the start of your appointment and must be made no later than 5.00pm the day before your treatment. If booked directly with us there is a 5% non-refundable credit card fee (included in all our prices as shown), this is non-refundable even when cancelled within the cancellation time-frame. When cancelled or no-show within the cancellation time, no refunds are possible.

ICE BATH

Cancellations & rescheduling appointments must be made 24 hours before the start of your appointment and must be made no later than 5.00pm the day before your treatment. If booked directly with us there is a 5% non-refundable credit card fee (included in all our prices as shown), this is non-refundable even when cancelled within the cancellation time-frame. When cancelled or no-show within the cancellation time, no refunds are possible.

Section 2 – Massage Terms

There are physical conditions and health problems that it is not advised to receive a massage as it may be unsafe. If you have any of the conditions listed below, we advise you consult a doctor/physician before booking in your massage treatment or services. 

  • Cuts or open wounds
  • Bruises
  • Varicose veins
  • Blood clots
  • Broken bones
  • Burns
  • Severe skin conditions
  • Pregnancy
  • Liver condition
  • Kidney condition
  • Cancer
  • Inflammation
  • Uncontrolled hypertension

Additionally, if you have any of the following physical conditions or health problems, we ask that you do not book a massage as it is putting you, your therapist or your therapist’s other clients at risk. If you do have any of the following conditions and arrive for a booked treatment, we reserve the right to ask you to leave without receiving your service and reserve the right to refuse a refund.

  • Contagious diseases
  • A new or worsening cough
  • A fever of at least 38°C
  • Shortness of breath
  • Sore throat
  • Sneezing and runny nose
  • Temporary loss of smell
  • Under the influence of alcohol, drugs, or illicit/illegal substances

After you have finished your massage, if you want to shower to rinse off and refresh, please prebook the shower when booking in your massage appointment as we do need to prepare the room for the next client. If you have forgotten to prebook your shower but would still like to rinse off, please let a staff member know and we have another shower at Nadi that we can bring you to. 

Please try to vacate the room within 10 minutes at the end of your treatment or shower, as we have to prepare for the next client. A timer will be set for you to keep you aware of when to exit the room.

The minimum age for a massage is 16 years of age. If you are under 18  years of age, a legal guardian must sign your waiver as consent on your behalf.

Finally, it is forbidden to initiate or participate in any sexual activity at Nadi. If you do, you will be asked to leave and will not receive a refund. Additionally, you may be reported to the authorities for any inappropriate sexual advances or behaviour.

Section 3 – Yoga Terms

There are physical conditions and health problems that it is not advised to attend yoga as it may be unsafe. If you have any of the conditions listed below, we advise you consult a doctor/physician before booking into a yoga class at Nadi. Additionally, please let your yoga teacher know of any recent injuries, surgeries, or ailments so that the teacher can help you with modifications to avoid injury.

  • Knee condition/injury/pain
  • Hernia/Ulcer
  • Hypertension
  • Frozen shoulder
  • Back condition/injury/pain
  • Surgery
  • Inflammation
  • Wrist condition/injury/pain

  • Hip condition/injury/pain
  • Broken bones
  • Joint condition/injury/pain
  • Tendon condition/injury/pain
  • Ligament condition/injury/pain

Additionally, if you have any of the following physical conditions or health problems, we ask that you do not book into yoga as it is putting you, your teacher or your other students at risk. If you do have any of the following conditions and arrive for a yoga class, we reserve the right to ask you to leave without receiving your service and reserve the right to refuse a refund.

All mats and props are provided at Nadi if you would like to use them. If you prefer to bring your own you are more than welcome to.

Section 4 – Salt Float Terms

There are physical conditions and health problems that it is not advised to receive a salt float therapy treatment as it may be unsafe. If you have any of the conditions listed below, we advise you consult a doctor/physician before booking in your salt float therapy treatment or services. If you do have any of the following conditions and it is unsafe for you to have the salt float therapy treatment, we reserve the right to ask you to leave without receiving your service and reserve the right to refuse a refund.

  • High blood pressure
  • Low blood pressure
  • Epilepsy/Seizure Disorder
  • Kidney Disease
  • Currently experiencing Diarrhoea/Incontinence
  • Gastroenteritis 
  • Open Wounds or Skin Ulcers 
  • Claustrophobia 
  • Heart Conditions 
  • Sensitivity to Chlorine, Bromine, Sulfate or Magnesium 
  • Severe Skin Conditions such as Psoriasis and Eczema 
  • Psychosis
  • Vertigo/Motion Sickness
  • Mobility Issues 
  • Chemotherapy
  • Burns
  • Sunburnt
  • Pregnancy

If any of the following apply to you, we ask that you do not book your salt float therapy treatment until the appropriate length of time has passed. If you do have any of the following, we reserve the right to ask you to leave without receiving your service and reserve the right to refuse a refund. If you do receive the treatment and cause additional cleaning/maintenance to the salt float, you will be charged an additional $200 cleaning and equipment maintenance fee.

  • Under the influence of alcohol, drugs, or illicit/illegal substances
  • Contagious Disease/Fever/Cold/Flu Symptoms
  • Had your hair coloured in the last 2 weeks
  • Had a keratin treatment to your hair in the last 4 weeks
  • Had a spray tan in the last 2 weeks
  • Currently have henna colouring in your hair
  • Been tattooed in the last 4 weeks
  • Shaved in the last 48 hours
  • Waxed in the last 48 hours

If you are currently menstruating, we ask that you please reschedule your salt float therapy session to a different stage in your cycle.

Before entering the float tank, we ask that you do the following:

  • Please shower before using the salt float
  • You are advised to use the earplugs provided. Insert ear plugs before entering the shower as they adhere better when dry.
  • Please remove contact lenses 
  • Seal any small cuts with petroleum jelly
  • Do not condition your hair prior to floating
  • Wipe your face dry before entering the pod. This helps prevent salt water from getting in your eyes while you float.

When receiving a salt float therapy treatment, you do run the risk of becoming dizzy or nauseous. It is your responsibility to listen to your body. Please prepare by keeping your body hydrated and if you feel yourself becoming unwell you can exit the float tank pod at any time.

If you fall asleep, you will stay afloat due to the buoyancy of the water. Some discomfort may occur if the salt water gets in your eyes. While drowning in a floatation tank is possible, it is extremely unlikely.

When you exit the float tank, be sure to tilt your head back to avoid getting saltwater in your eyes. Please be aware that the floor may be slippery when wet. 

After you have finished your float, you will want to shower to rinse off the salt from your body, ears, and hair as well as refresh. Please try to vacate the room within 10 minutes at the end of your treatment, as we have to prepare for the next client. A timer will be set for you to keep you aware of when to exit the room.

Section 5 – Infrared Sauna Terms

There are physical conditions and health problems that it is not advised to receive an infrared sauna therapy treatment as it may be unsafe. If you have any of the conditions listed below, we advise you consult a doctor/physician before booking in your infrared sauna therapy treatment or services. If you do have any of the following conditions and it is unsafe for you to have the infrared sauna therapy treatment, we reserve the right to ask you to leave without receiving your service and reserve the right to refuse a refund.

  • High blood pressure
  • Low blood pressure
  • Pregnant
  • Kidney disease
  • Liver disease
  • Open Wounds or Skin Ulcers
  • Claustrophobia
  • Heart Conditions
  • Mobility Issues
  • Circulatory System Problems
  • Diabetes Type 1
  • Diabetes Type 2
  • Multiple Sclerosis 
  • Haemophilia 
  • Contagious Disease/Fever/Cold/Flu Symptoms
  • Skin Insensitivity to Temperature
  • Skin Hypersensitivity to Temperature
  • Joint Injury in last 48 Hours
  • Injury causing Inflammation in last 48 Hours
  • Burns
  • Medications
  • Pregnancy

If you are under the influence of alcohol, drugs, or illicit/illegal substances or currently have a contagious disease/fever/cold/flu symptoms, we ask that you do not book your infrared sauna treatment. If you do book in while under the influence, we reserve the right to ask you to leave without receiving your service and reserve the right to refuse a refund. If you do receive the treatment and cause additional cleaning/maintenance to the infrared sauna,  you will be charged an additional $200 cleaning and equipment maintenance fee.

Do not use the sauna immediately following strenuous exercise. Please wait at least 30 minutes to allow the body to cool down completely. 

When receiving an infrared sauna therapy treatment, you do run the risk of becoming overheated, dehydrated or dizzy if you are in it for too long and not properly hydrated. Always stay hydrated while using the sauna to replenish lost fluids from the body due to perspiration.

It is your responsibility to listen to your body. If you feel yourself becoming overheated, the ceiling vent can be opened at any time for air circulation or you can step out of the sauna at any time.

Please shower before using the sauna. Once you enter the infrared sauna, place a towel on the bench and floor to sweat off the wood and floor tile, and keep an extra towel handy to wipe any extra sweat from your body. Please avoid touching the surface of the heaters behind the wood frames as they will be hot and may cause burns. After you have finished in the sauna, you can shower to refresh.

There are physical conditions and health problems that it is not advised to receive an ice bath therapy treatment as it may be unsafe. If you have any of the conditions listed below, we advise you consult a doctor/physician before booking in your ice bath therapy treatment or services. If you do have any of the following conditions and it is unsafe for you to have the ice bath therapy treatment, we reserve the right to ask you to leave without receiving your service and reserve the right to refuse a refund.

  • High blood pressure
  • Low blood pressure

If any of the following apply to you, we ask that you do not book your ice bath therapy treatment until the appropriate length of time has passed. If you do have any of the following, we reserve the right to ask you to leave without receiving your service and reserve the right to refuse a refund. If you do receive the treatment and cause additional cleaning/maintenance to the ice bath, you will be charged an additional $200 cleaning and equipment maintenance fee.

  • Under the influence of alcohol, drugs, or illicit/illegal substances

You are welcome to go between a hot shower and the ice bath as many times as you would like throughout the duration of your appointment. Please be aware that the floor may be slippery when wet. 

Please try to vacate the room within 10 minutes at the end of your treatment, as we have to prepare for the next client. A timer will be set for you to keep you aware of when to exit the room.

Section 7 – Online Store Terms 

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

Section 8 – General Conditions 

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Section 9 – Accuracy, Completeness and Timeliness of Information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Section 10 – Memberships & Modifications to the Service and Prices

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Billing for Membership to Classes. Memberships, which provide you with access to Classes, are billed on a periodic basis as specified at the time of purchase (e.g., weekly, monthly, or yearly). Memberships give you access to in studio classes and live streamed classes and do not include access to 4 Week Series, Workshops, Trainings or Online Classes. Your Membership subscription will continue in effect on a recurring basis corresponding to the term of your membership unless and until you cancel your membership or the account or the Service is otherwise suspended or discontinued pursuant to this Agreement. If membership is cancelled or terminated before the end of the applicable billing cycle, Nadi will not reimburse the Member for the remainder of that paid month. Members may cancel their membership at any time after the required 3 month commitment is met. Membership must be cancelled prior to the renewal date in order to avoid additional membership charges. At times, special prepaid membership packages will be available for purchase at varying lengths of time as specified at the time of purchase. Special prepaid memberships will be recurring and will renew automatically on the expiry date.

Pricing for Membership Subscriptions. When you purchase a membership subscription, you will initially be charged at the rate applicable at the time of your agreement to subscribe. If Nadi later increases the price of the subscription, Nadi will notify you via email. The increase will apply to the next payment due from you after the notice, provided that you have been given at least 10 days’ prior notice before the charge is made. If you are given less than 10 days’ prior notice, the price increase will not apply until the payment after the next payment due.

No Sharing of Membership Subscriptions. Members of Nadi may not share, give or sell their password or username to any other person or entity. Excessive viewings by any Member will be construed by Nadi as fraudulent use of the Service, which will result in the immediate cancellation of membership without refund. When becoming a Member you agree to take all actions possible to protect your username and password from fraudulent use. Nadi reserves the right to cancel any membership it believes has been compromised, or is being used fraudulently, at its own discretion.

Section 11 – Products or Services

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

Nadi Wellness is not a healthcare specialist and therefore cannot tell you whether you should or shouldn’t perform an exercise. Always consult your doctor, physician or healthcare specialist before participating in any movement, breathwork or exercise classes (this includes classes taught by Nadi Wellness teachers in studio, live streamed and online).

All exercises and use of this program are performed strictly at your own risk.

By purchasing our Nadi online/live streamed/in studio yoga class or workshop, massage or holistic therapy, it is understood that the instructions given throughout are intended only as a guidance. It is therefore the responsibility of the person practising/the user to adjust the practice/movements to his/her/their limitations to ensure no personal injury occurs.

The person practising/the user will take full responsibility for himself/herself/themself during any Nadi online/live streamed/in studio yoga class or workshop, massage or holistic therapy, and Nadi Wellness is released of any responsibility for any injury sustained and will not be responsible for any direct, indirect, consequential, special, exemplary or other damages, complications or injuries that may result from the use of our Nadi online/live streamed/in studio yoga class or workshop, massage or holistic therapy.

In no case shall Nadi, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

By attending a class or service at Nadi, you have read, understood, and agreed to comply with the rules and safety precautions displayed and/or explained to me verbally relating to the wellness facilities, services and classes provided by Nadi (“the services”). 

  1. You understand that it is a condition of taking part in the services that you must give the confirmations and certification set out in this form. 
  2. You are not under the influence of drugs, alcohol or illegal substances.
  3. You are 16 years or older.
  4. You will not add anything to the water if you am receiving a float treatment or ice bath therapy. You understand that if you add anything to the water you will be charged an additional $200 in cleaning fees and equipment maintenance. 
  5. You understand that it is forbidden to initiate or participate in any sexual activity at Nadi. If you do, you will be asked to leave and will not receive a refund. Additionally, you may be reported to the authorities for any inappropriate sexual advances or behaviour.
  6. You have had the opportunity to ask Nadi all the questions that you have relating to the services, and all information you require has been provided by Nadi. 
  7. You do not have any physical condition or health problem which would make it unsafe or against medical advice for you to participate in the services. Any preexisting medical conditions you have, you have consulted with a doctor/physician and have been advised it is safe to go ahead with treatments, services, and/or classes.
  8. You acknowledge that the services involve exercise, infrared heat, and/or water. Careless actions or not following the health and safety procedures outlined by the Nadi team can carry the risk of serious injury or death, as well as damage to property. These risks can arise from your own actions. 
  9. You accept responsibility to ask for assistance by a Nadi team member if you are unsure how to safely operate the equipment or practise a pose.
  10. You assume and accept all of the risks involved in participating in the services including (by way of example and not limitation) any risk, injury, or damage that may arise from the services, classes, and from equipment.
  11. You confirm and undertake on behalf of yourself, your executors, administrators and successors as follows: 
    1. You waive, release and discharge Nadi from all liability of any kind, for your death, disability, personal injury, property damage, or any loss of any kind which you may suffer if you take part in the services. 
    2. You indemnify Nadi from any and all liabilities or claims made as a result of you taking part in the services, from whatever cause. 
    3. The certifications and confirmations contained in this form are given for the benefit of and extend to Nadi, its officers, its employees, its agents and representatives and the term Nadi in this form shall include all such persons. 

Section 20 – Indemnification 

You agree to indemnify, defend and hold harmless Nadi and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Section 21 – Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Section 22 – Termination

This Agreement shall remain in full force and effect for so long as it is posted on the Website. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

You may suspend or terminate your membership at any time and for any reason after your minimum 3 month commitment is fulfilled, by emailing [email protected]. If you cancel your membership before the end of the applicable billing cycle, your account will be cancelled as of the following month. You will not receive a refund for the current billing period.

Nadi reserves the right to terminate your account or your access to the Service immediately, with or without notice to you, and without liability to you, if Nadi believes that you have breached any of the terms of this Agreement, furnished Nadi with false or misleading information, or interfered with use of the Service by others.

When you close or de-activate your account or if your account is otherwise terminated, we have the right, but not the obligation, to store your personal information, settings, saved and completed classes, and teachers you have followed. Unless we have exercised our right to terminate your account, you can re-activate your account at any time by contacting us.

Section 23 – Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand.

REFUND POLICY

We have a 14-day return policy, which means you have 14 days after receiving your item to request a return.

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

To start a return, you can contact us at [email protected]. If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Our online yoga classes have a 7-day return policy, which means you have 7 days after the purchase to request a return. We reserve the right to determine if you are eligible for a refund as a case-by-case basis. Please email [email protected] if you have any questions.

DAMAGES & ISSUES

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item so that we can evaluate the issue and make it right.

EXCEPTIONS / NON-RETURNABLE ITEMS

Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalised items), and personal care goods (such as beauty products). We also do not accept returns for hazardous materials, flammable liquids, or gases. Please get in touch if you have questions or concerns about your specific item.

Unfortunately, we cannot accept returns on sale items or gift cards.

EXCHANGES

The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

REFUNDS

We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Nadi Members are not entitled to a refund in the event they choose not to continue a training or courses. If a Member is terminated due to a violation of this Agreement, Nadi will not reimburse the Member for the remainder of any training or courses, nor will reimbursements be made for cancellations prior the completion of any training or courses. As part of the training and courses, instructors may provide training or course materials that you may download. Such training or course materials may only be used for your own personal, non-commercial use. You may not otherwise copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any training or course materials, nor may you modify or create derivative works related to such training or course materials.
